Due Date – 28th February for POSH Return [Gurugram]

The District Officer under the POSH Act, 2013, has mandated that all government and non-government bodies submit their annual reports detailing cases of workplace harassment. This annual compliance report must be submitted by February 28th each year, ensuring adherence to the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013.

For easy access, the checklist and submission notice can be found at https://gurugram.gov.in/shww . Failure to meet this requirement may result in a hefty penalty of Rs. 50,000 for the employer, alongside potential strict action for continued non-compliance.

Exemption for IT and ITES Establishments in Uttar Pradesh

Pursuant to the authority granted by Section 3(3) of the Uttar Pradesh Dookan Aur Vanijya Adhisthan Adhiniyam, 1962, the Governor hereby exempts Information Technology (IT) and Information Technology Enabled Services (ITES) establishments in Uttar Pradesh from Sections 6 and 7 of the Act for a period of two years from the date of this notification, subject to the following conditions:

  1. Working Hours:
    • Young persons (ages 14-18): Maximum of 6 hours per day.
    • Other employees: Maximum of 12 hours per day (including rest intervals).
  2. Rest Intervals: Employees must receive a minimum of half an hour rest after five hours of continuous work. Total work and rest periods must not exceed 12 hours in a day.
  3. Overtime:
    • Work exceeding 48 hours per week will be classified as overtime, entitling the employee to overtime wages.
    • Overtime pay shall be at twice the ordinary rate, which includes basic wages and applicable allowances (excluding bonuses).
  4. Overtime Limit: Total overtime hours shall not exceed 125 hours in any quarter (defined as three consecutive months starting January 1, April 1, July 1, or October 1).
  5. Weekly Off: Every employee is entitled to a weekly day off.
  6. Public Holidays: Employees working on designated public holidays shall receive compensatory leave.
  7. Safety Measures: Employers must ensure adequate security and transportation for women employees during night shifts.

The Government of Maharashtra Gazette Extraordinary Volume VIII, dated March 18, 2024/Falguan 28, Shak 1945, the Maharashtra Labour Welfare Fund Amendment Act 2024 has been revised to increase the contribution rate to Rs 25/- per employee and thrice that rate for an employer. Please refer notification for more details.
